The report, which also contains commentaries on the draft articles, appears in Yearbook of the International Law Commission, 2001, vol. II (Part Two). Text reproduced as it appears in the annex to In particular, this article considers whether the commentaries on the articles of the OECD Model Tax Convention on Income and on Capital1 are a legally valid external interpretive tool. The analysis also considers the availability of internal tools for treaty interpretation. Insofar as provisions of the present draft articles correspond to those of the articles on State responsibility, and there are no relevant differences be- tween organizations and States in the application of the respective provisions, reference may also be made, where appropriate, to the commentaries on the latter articles.
